Terms of Service
Last updated: September 13, 2026
Overview
Welcome to PressViable™. The terms “we,” “us,” and “our” refer to PressViable™, a service of Editorial Style LLC (“Editorial Style”). PressViable™ provides tools for modeling newsroom staffing plans, revenue mixes, and operating budgets against regional economic data — including census demographics, wage benchmarks, and local giving data — to produce a feasibility assessment (the “Services”).
These Terms of Service (“Terms”), together with our Privacy Policy, describe your rights and responsibilities when you use the Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.
Section 1 — Access and Account
You must be at least the age of majority in your jurisdiction to use the Services. To use most features of the Services, you must create an account. You represent that all information you provide is accurate and complete, and you are solely responsible for maintaining the security of your account credentials and for all activity under your account.
Section 2 — What PressViable™ Does
PressViable™ allows you to input assumptions about a newsroom or media organization — including staffing roles, salaries, revenue mix, and target market — and generates a modeled feasibility score and related analysis (a “Model”) by comparing those assumptions against third-party economic reference data, including U.S. Census Bureau data (ACS 5-Year, County Business Patterns), Bureau of Labor Statistics data (OEWS), and IRS Statistics of Income / Form 990 extracts.
You may build a Model for an organization you operate, are evaluating, or are considering funding, whether or not it is your own organization. You represent that any information you input about a third-party organization is your own good-faith estimate or publicly available information, and that your use of the Services complies with applicable law.
PressViable™ does not independently verify the accuracy of assumptions you input, and a Model reflects the assumptions provided, not audited or confirmed data about any specific organization.
Section 3 — Accuracy Disclaimer; Not Financial or Professional Advice
Models are generated using automated calculations based on the assumptions you provide and third-party reference data (census, wage, and philanthropic data), and are provided for informational purposes only. PressViable™ does not guarantee the accuracy, completeness, or currentness of any score, feasibility assessment, or recommendation, and reference data may be outdated, revised, or unavailable for a given market.
A Model is not financial, legal, tax, or professional advice, and is not a guarantee that any organization, business plan, or staffing plan is or will be viable, fundable, or successful. Underlying reference data (such as census or wage figures) may not reflect current, local, or organization-specific conditions. You are solely responsible for any business, financial, employment, career, or funding decision you make, including any decision to launch, staff, fund, or discontinue an organization, and you should not treat a Model as a substitute for independent financial, legal, or professional advice specific to your situation.
Section 4 — Pricing
PressViable™ is currently provided free of charge. We reserve the right to introduce paid tiers or features in the future; if we do, this section will be updated and any change will not affect free features already in use without notice given in advance.
Section 5 — Intellectual Property
The Services, including all PressViable™ scoring methodology, criteria, design, text, and software, are owned by Editorial Style or its licensors and protected by applicable intellectual property laws. Subject to your compliance with these Terms, you may use a Model for your own internal business purposes, including sharing it with your organization’s staff, board, funders, or leadership. You may not resell, redistribute for commercial purposes, or represent a Model as independently produced by you.
PressViable™’s name, logo, and scoring methodology are trademarks/proprietary material of Editorial Style. You may not use them without prior written permission.
Section 6 — Prohibited Uses
You may not use the Services to: violate any law; infringe intellectual property or other rights of any party; harass, defame, or harm any person; submit false or misleading information about a real organization or individual with intent to mislead a third party (such as a funder) relying on a Model; attempt to circumvent access controls; use unauthorized scraping, automated data extraction, or bulk-download tools against the Services; or interfere with the security or normal operation of the Services.
Section 7 — Feedback
If you submit feedback, suggestions, or ideas about the Services, you grant us a perpetual, royalty-free license to use them for any purpose, including improving the Services, without obligation to compensate you or keep them confidential.
Section 8 — Errors and Changes
We may correct errors in scoring, calculations, or reference data, and may update or discontinue features of the Services, at our discretion and without prior notice.
Section 9 — Termination
We may suspend or terminate your account or access to the Services at our discretion, without notice, including for violation of these Terms. Provisions that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
Section 10 — Disclaimer of Warranties
THE SERVICES AND ALL MODELS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE EXPRESSLY DISCLAIM ANY AND ALL RESPONSIBILITY OR LIABILITY FOR THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OPERABILITY, OR AVAILABILITY OF ANY MODEL OR OTHER INFORMATION DISPLAYED THROUGH THE SERVICES, INCLUDING THIRD-PARTY REFERENCE DATA. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT FULLY APPLY TO YOU.
Section 11 — Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EDITORIAL STYLE AND PRESSVIABLE, AND OUR OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST FUNDING, OR LOST EMPLOYMENT OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICES OR ANY MODEL, INCLUDING ANY BUSINESS, FINANCIAL, EMPLOYMENT, OR FUNDING DECISION MADE OR ACTION TAKEN IN RELIANCE ON A MODEL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WE WILL NOT BE LIABLE FOR ANY DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND OUR REASONABLE CONTROL. TO THE EXTENT ANY LIABILITY IS NOT OTHERWISE EXCLUDED, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO A SPECIFIC MODEL WILL NOT EXCEED $0, AS THE SERVICES ARE PROVIDED FREE OF CHARGE.
Section 12 — Indemnification
You agree to indemnify and hold harmless Editorial Style, PressViable™, and our officers, employees, and service providers from claims arising from your breach of these Terms, your violation of law or third-party rights, or your use of the Services.
Section 13 — Severability; Waiver; Entire Agreement; Assignment
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms constitute the entire agreement between you and us regarding the Services. You may not assign these Terms without our consent; we may assign them without restriction.
Section 14 — Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law, without regard to conflict of law principles. You consent to venue and jurisdiction in Pennsylvania courts.
Section 15 — Changes to These Terms
We may update these Terms at any time by posting the revised version with an updated “Last updated” date. Continued use of the Services after changes constitutes acceptance.
Section 16 — Contact
Questions about these Terms should be sent via our contact form.
